DOT/SAP PROCESS OVERVIEW

What is a DOT/SAP Evaluation?

SAP stands for Substance Abuse Professional. In the context of DOT regulations, a SAP is a qualified professional who plays a required role in the return-to-duty process after an employee violates DOT drug and alcohol testing rules.

A Substance Abuse Professional (SAP) evaluation is required by federal law (49 CFR Part 40) for any DOT-regulated employee who has violated drug or alcohol policy. The SAP assesses the employee, recommends treatment or education, and provides follow-up testing and return-to-duty documentation. Jonathan Tobia is a federally qualified SAP listed in the FMCSA Clearinghouse.

For NJ DOT-regulated employees, the SAP process is designed to protect public safety while also giving employees a structured path toward returning to work.

HOW WE CAN HELP

DOT / SAP Evaluations

Per federal law 49 CFR Part 40, an evaluation from a Substance Abuse Professional is required before return to safety-sensitive duty. We provide DOT-compliant evaluations for all regulated transportation sectors.

Treatment & Referral

Following evaluation, we coordinate appropriate SUD or mental health treatment, monitor compliance, and provide follow-up documentation for DOT return-to-duty requirements and licensing boards.

NJ RAMP Program

Also serving nurses in the NJ Recovery & Monitoring Program. RAMP participants undergo a comprehensive SUD and/or mental health evaluation as part of the alternative-to-discipline process.

CDL / Commercial Trucking

FMCSA regulated. Clearinghouse required for all CDL holders with substance violations.

Aviation Pilots & FAs

FAA regulated. Covers commercial pilots, private pilots, and flight attendants.

US Coast Guard

USCG credentialed mariners. Substance policy under 46 CFR Part 16.

Port of Newark Workers

Longshoremen, port authority employees, TWIC card holders.

MTA & Transit Workers

FTA regulated. Union EAP policies often cover evaluations.

Jonathan Tobia is a credentialed International Certified Alcohol and Drug Counselor (ICADC) and a federally qualified Substance Abuse Professional (SAP) under DOT 49 CFR Part 40. With extensive experience in transportation-sector evaluations, Johnathan specializes in return-to-duty assessments for CDL truck drivers, commercial airline pilots, flight attendants, US Coast Guard credentialed mariners, Port of Newark workers, and MTA/transit employees. What to Expect During an Evaluation

A SAP evaluates the employee and determines what steps are necessary before the employee can be considered eligible for return-to-duty testing. The SAP does not decide whether the employer must rehire or reinstate the employee. Instead, the SAP determines whether the employee has successfully complied with the recommended education or treatment plan.
